You Were Served Divorce Papers? A 3 Day Action Plan

Today

o Don't panic - best decisions are made with a cool, calm head

IN RI

o Sit down, relax, and read the divorce papers several times.

o Don't call your spouse in anger - no contact is best for now.

o Read up on divorce - knowledge always helps take the fear away.

o When you finish the above steps, take a short break and then read all of the divorce papers again until you thoroughly understand what is ahead.

o If you have children, do not draw them into the conflict. This is best for your children and will put you in the best position to win custody.

o You have 20 days from the date you received the summons to send an answer.

o If possible, take tomorrow off and devote some thought to the situation.

Tomorrow

o You must decide if you will represent yourself or hire an divorce attorney.

o If you want an attorney, start calling and find one that you like.

o If you are a do-it-yourself person, continue to read about divorce for 7 more days. You have almost two weeks to act and you must become well informed.

o Review the location and amount of all your assets. If possible, remove money from the bank and put it in a place of security. Do not deprive your spouse of necessary funds to live on. That could backfire on you.

o Review your credit cards and any other sources of credit. If possible, cancel cards that are joint accounts or remove your spouse's name from the card.

o Begin to collect all records of assets, amounts owed, property, deeds, and family business records. If you are in the marital home, keep the records in a more secure place, like with a trusted friend.

o Call the IRS to find out how to request copies of the last 5 years of tax returns - if you don't already have them.

Next Day

o Continue your education. This is one of the biggest and most important projects of your life. Read books and attend seminars. Become an expert.

o Make a financial plan or a household budget for the next 12 months. Don't spend unnecessary money.

o Get a notebook and a holder for paperwork. Set up a central collection point for all the information you gather during your divorce. Keep a detailed diary and jot down anything you learn from your educational efforts.

The Steps of a Class Action Lawsuit

A class action lawsuit is used when a group of individuals have all suffered from the same wrongdoing. These people are all being affected similarly and as a result, a class action lawsuit can be filed. Some of the more common lawsuits are cases that pertain to consumers harmed by defective products or employees being discriminated against by their employer. There are many different steps to the class action lawsuit process, but each one is fairly simple.

At this level, the lawsuit will need to be classified as a "class-action" level by the courts. As long as every member of the group shares a legal issue and the group has enough people, it will be approved as a class action lawsuit.

First, an individual will be named as a Lead Plaintiff. This person will become the representative for the group and therefore, he or she will be the main spokesperson for the case.

Once the case has been approved and a Lead Plaintiff has been named, a direct piece of mail will be sent out to each member in the group. Members have the choice to either follow through with the group lawsuit or pursue the claim on their own. Many individuals choose the group lawsuit route because it is a better option financially than pursuing a case independently. The class action notice that is sent out to each group member is a vital piece of paper for each involved party. It will list the purpose of the lawsuit, the class that is being represented, the contact information of each lawyer that is handling the case, deadlines pertaining to the trial and an option for opting out of the group lawsuit.

The main goal of any lawsuit is to reach a settlement, preferably before going to court. Most times, this does happen and a decision can be agreed upon that is fair to every party. After the court approves the agreement, each member of the class action lawsuit will be notified through the mail.

The amount of money gained by each member in a class action lawsuit is determined by the settlement amount, the number of members in the lawsuit and the attorney's fee. The larger the amount of people involved in the suit, the less amount of money each member will recover. A lawyer's fees are normally taken directly from the settlement amount as well instead of charging each client separately.

In movies, we often are shown the legal process of class action lawsuits. Why might this be? Class action lawsuits are inherently dramatic, because they involve a large number of plaintiffs and a great wrong that has affected all of them, and maybe the public at large.

There are many advantages and disadvantages of taking your class as a class action suit. Advantages include the very reason why this type of case was invented and formed-when there is a large group of people who have the same arguments against the same person, company, government. In some cases it is just more efficient to group all the cases together, because the defense is going to be the same, and settlement is so large that there will be less paperwork in awarding a large settlement, versus many tiny ones.

Another advantage is the old adage "strength in numbers." With more people, there is more evidence, and shows that this may not be an isolated incidence. This can lean towards the sympathetic court system and help the plaintiffs win the settlement they deserve. If one person has a stronger case, the ones with weaker cases can still benefit from a settlement.

The main disadvantage for those who join a class action suit is that if someone is proved not to have a case it can affect the settlement amount, as well as the overall ruling. No one may receive any settlement, which could work against all. Class action suits are also very expensive, so even if a settlement is won, the lawyer fees are going to take a large chunk out of the total settlement. 

Although this is a group case, it does not mean that the settlement of trial refers to every plantiff. These so called "mass actions" can work for some and work against others-it just depends on the case. Mass action does not really save or earn people more money, but in reality, can get in the way of settlement money that some people are relying on to help them live normal lives.
